Terms of Service

Effective date: 23 March 2026

1. Agreement to Terms

By accessing or using the Calltana service ("Service"), operated by Cohen / Media Pty Ltd ABN [to be inserted] ("we", "us", "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users of the Service, including business owners, their staff, and any authorised representatives.

2. Description of Service

Calltana provides an AI-powered multi-channel communication platform that:

  • Answers incoming phone calls on behalf of your business (AI receptionist)
  • Responds to WhatsApp messages from your business number (WhatsApp AI add-on)
  • Provides a website chatbot widget that answers customer questions on your website (Website Chatbot add-on)
  • Reads and responds to customer emails sent to your business (Email AI add-on)
  • Books appointments and captures lead information across all channels
  • Sends notifications and summaries
  • Provides a web dashboard for analytics, conversation management, and account settings

The Service uses artificial intelligence and may not always respond perfectly. We continuously improve accuracy but do not guarantee error-free performance. AI responses are generated in real time and may occasionally contain inaccuracies.

3. Account Registration

To use the Service, you must provide accurate and complete business information during onboarding. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activity that occurs under your account
  • Keeping your business information, hours, services, and pricing current
  • Notifying us promptly of any unauthorised access

4. Subscription Plans, Add-Ons, and Billing

Plans: We offer monthly subscription plans with varying included minutes. Current plans and pricing are listed on our website at calltana.com/pricing.

Channel add-ons: WhatsApp AI (+$99/mo), Website Chatbot (+$49/mo), and Email AI (+$79/mo) are optional add-ons to your base plan. Add-ons are billed in addition to your base plan and can be added or removed at any time from your dashboard. Changes take effect at the start of your next billing cycle.

Billing cycle: Subscriptions are billed monthly in advance. Your billing cycle starts on the date you subscribe.

Payment methods: We accept credit/debit cards and Australian BECS Direct Debit. All payments are processed securely via Stripe.

Overages: If your usage exceeds your plan's included minutes, overage charges apply at the rate specified in your plan. Overages are billed at the end of each billing cycle.

Price changes: We may change prices with 30 days' written notice. Price changes take effect at the start of the next billing cycle after the notice period.

Taxes: All prices are in Australian dollars and are exclusive of GST unless stated otherwise. GST will be added where applicable.

5. No Lock-In Contract

All plans are month-to-month with no minimum commitment period. You may cancel at any time. Cancellation takes effect at the end of your current billing period. No exit fees or penalties apply.

6. Data, Recordings, and Conversation Logs

Call recording: All calls handled by the Service are recorded and transcribed. You are responsible for ensuring callers are informed that calls may be recorded, in accordance with applicable Australian state and territory laws.

Conversation logging: All WhatsApp messages, website chat conversations, and email exchanges processed through the Service are logged and stored. The AI greeting informs customers they are interacting with an AI assistant.

Email integration: If you connect your Gmail or Outlook account, you authorise Calltana to read incoming emails and send replies on your behalf using the AI. You may disconnect at any time from your dashboard. We store encrypted OAuth tokens and do not access your email password.

WhatsApp number registration: If you register your existing phone number with our WhatsApp Business API, you acknowledge that the number will be disconnected from the WhatsApp Business App and managed through the Calltana platform. You may disconnect and reclaim your number at any time.

Your data: You retain ownership of all business information you provide and all conversation data generated through your use of the Service across all channels.

Our use: We may use anonymised, aggregated data to improve the Service. We will not share your identifiable business data with third parties except as required to deliver the Service (e.g., telephony providers, AI providers, booking system integrations).

7. Acceptable Use

You agree not to use the Service to:

  • Provide false or misleading information to callers
  • Conduct illegal activities or facilitate fraud
  • Spam, harass, or abuse callers, WhatsApp contacts, chat visitors, or email recipients through our systems
  • Send unsolicited bulk messages via WhatsApp, chat, or email through the Service
  • Reverse-engineer, copy, or attempt to extract our AI technology
  • Resell the Service without our written consent

We reserve the right to suspend or terminate accounts that violate these terms.

8. Service Availability

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice where possible. We are not liable for downtime caused by third-party providers (telephony, hosting, payment processors).

9. Limitation of Liability

To the maximum extent permitted by Australian law:

  • Our total liability for any claim arising from the Service is limited to the fees you paid in the 3 months prior to the claim
  • We are not liable for indirect, incidental, consequential, or punitive damages
  • We are not liable for lost revenue, missed calls, or business losses arising from AI errors or service interruptions

Nothing in these Terms excludes or limits liability that cannot be excluded under Australian Consumer Law.

10. Indemnification

You agree to indemnify us against any claims, losses, or damages arising from your use of the Service, including any claims from callers or third parties related to the information you provide to the AI system.

11. Intellectual Property

All technology, software, AI models, branding, and content comprising the Service remain our intellectual property. Your subscription grants you a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

12. Termination

By you: Cancel anytime via your dashboard or by emailing support@calltana.com. Service continues until the end of your current billing period.

By us: We may suspend or terminate your account for breach of these Terms, non-payment, or if required by law. We will provide reasonable notice where possible.

Effect of termination: Upon termination, your AI agent is deactivated across all channels — calls, WhatsApp, website chat, and email are no longer handled. Your WhatsApp number (if registered) will be released. Your email integration (if connected) will be disconnected. You may request export of your data within 30 days of termination. After 30 days, data may be deleted.

13. Dispute Resolution

These Terms are governed by the laws of New South Wales, Australia. Any disputes will first be addressed through good-faith negotiation. If unresolved, disputes will be submitted to the jurisdiction of the courts of New South Wales.

14. Changes to Terms

We may update these Terms from time to time. Material changes will be notified via email or dashboard notice at least 14 days in advance. Continued use after changes take effect constitutes acceptance.
